Job Offer Letter: questions people ask

Is an offer letter an employment contract?

It can be treated as one if it promises job security or a fixed term. This template includes an at-will statement, which is standard in most US states but does not apply in Montana after a probationary period.

Do I need to state exempt or non-exempt status?

It is not always legally required in an offer letter, but stating it helps avoid overtime disputes. Several states require written notice of pay rate and payday at hire.

Can the candidate sign electronically?

Yes. E-signatures on offer letters are widely used and generally valid under US federal and state law.

Can I include a non-compete in the offer?

This template does not. Non-competes are banned or restricted in a number of states, and rules change frequently, so use a separate agreement reviewed by counsel.

What about Form I-9?

New hires must complete Form I-9 by their first day of work, with the employer reviewing documents within three business days of the start date. The offer can be contingent on it.
