Demand Letter for Payment: questions people ask
Is a demand letter required before suing?
Not always, but some courts and statutes expect or require a demand first, and judges look favorably on attempts to resolve the matter.
Can I add interest or fees?
Only if your contract or state law allows them. Adding unauthorized fees can undermine your claim.
Are there rules for collecting debts?
Original creditors collecting their own debts have fewer restrictions, but threats you do not intend to carry out, harassment, or contacting third parties can violate state law. Third-party debt collectors are covered by the FDCPA.
Should I send it by certified mail?
Yes, or another trackable method, so you can show the court the debtor received it.
Does the letter need to be notarized?
No. A signed letter is sufficient.
