Cease and Desist Letter: questions people ask
Is a cease and desist letter legally binding?
No. It is a demand, not a court order. It puts the recipient on notice, which can matter later, for example in showing willful infringement.
Can a cease and desist letter get me in trouble?
Overstated or threatening letters can lead to counterclaims, such as a declaratory judgment suit in intellectual property disputes, or be published by the recipient. Keep it factual.
Should it be notarized?
No. A signature and accurate content are enough.
Can I email it?
Email is fine for speed, but also send a copy by certified mail or courier so you can prove delivery.
When should a lawyer send it instead?
When significant money, ongoing business or a likely lawsuit is involved, a lawyer's letter carries more weight and avoids mistakes.
