Promissory Note: questions people ask
Does the lender need to sign a promissory note?
No. A promissory note is a promise by the borrower, so only the borrower and any co-signer sign. The lender may sign to acknowledge the terms.
Should a promissory note be notarized?
It is not generally required for enforceability, though notarization helps if the signature is later disputed. Notes secured by real estate usually come with a notarized mortgage or deed of trust.
How is the estimated payment calculated?
It uses the standard amortization formula with the monthly rate equal to the annual rate divided by 12. Round the agreed amount and write it into the installment field if it differs.
Can a promissory note be signed electronically?
Many can. Notes meant to be sold or transferred as negotiable instruments raise extra questions under the UCC, so ask a lawyer if the note will be assigned.
What happens when the note is paid off?
The lender should mark the note paid and return it or give the borrower a written release.
