Rental Application: questions people ask
Can a landlord ask any question on an application?
No. The federal Fair Housing Act bars discrimination based on race, color, religion, sex, disability, familial status or national origin, and many states and cities add protections such as source of income. This form avoids questions about protected traits.
Is there a limit on application fees?
Several states and cities cap application fees or require them to match actual screening costs. Check local rules before charging.
Does the applicant's signature authorize a credit check?
The signed consent shows the applicant agreed. The Fair Credit Reporting Act requires a permissible purpose, and many screening companies have the applicant authorize directly as well.
What must I do if I deny an application based on a report?
Under the FCRA, a landlord who takes adverse action based on a consumer report must give the applicant an adverse action notice naming the reporting company.
Can applicants fill this on their phone?
Yes. Open it in Fill PDF or publish it with the form builder so applicants complete it in a browser and sign with a finger or mouse.
