Employee Warning Notice: questions people ask
Is the employee required to sign the warning?
No one can be forced to sign. If the employee refuses, note the refusal and have a witness sign that the warning was presented.
Does a written warning protect against a wrongful termination claim?
Clear, consistent documentation helps show a legitimate reason for later action. It does not prevent claims if discipline is applied unequally or in retaliation for protected activity.
Can employees add a rebuttal?
Yes, there is a section for it, and some states give employees a right to submit a rebuttal statement for their personnel file.
Should HR review before issuing?
Yes, especially for final warnings or when the employee recently took leave, complained, or asked for an accommodation.
