Sublease Agreement: questions people ask
Do I need the landlord's permission to sublet?
Most leases require written consent, and some states set rules on when a landlord can refuse. Subletting without required consent can be a lease violation.
Am I still responsible for rent after subletting?
Yes. The original tenant generally remains liable to the landlord for rent and damage if the subtenant does not pay or causes harm.
Can the sublease run past my lease end date?
No. A tenant cannot give more rights than they have, so the sublease must end on or before the master lease end date.
Does a sublease need to be notarized?
No. Signatures of the tenant, subtenant and, where required, the landlord are generally sufficient. E-signatures are generally accepted.
